These General Terms and Conditions of the Dutch Thuiswinkel Organization were established in consultation with the Consumers' Association and came into effect on 1 June 2014.

Article 1 - Definitions

In these conditions, the following definitions apply:

  • Additional agreement: agreement related to a distance contract.
  • Reflection period: period for exercising right of withdrawal.
  • Consumer: natural person not acting in professional capacity.
  • Day: calendar day.
  • Digital content: data produced in digital form.
  • Duration agreement: ongoing delivery agreement.
  • Durable data carrier: medium for storing information.
  • Right of withdrawal: consumer’s right to cancel.
  • Entrepreneur: member of Thuiswinkel.org.
  • Distance agreement: agreement concluded remotely.

Article 3 - Applicability

These terms apply to all offers and agreements between the entrepreneur and the consumer. The terms will be made available before concluding agreements.

Article 4 - The Offer

Offers include complete and accurate descriptions of products and services. Errors or mistakes do not bind the entrepreneur.

Article 5 - The Agreement

Agreements are concluded when the consumer accepts the offer. Electronic confirmations will be provided where applicable.

Article 6 - Right of Withdrawal

Consumers have 14 days to withdraw from a purchase without giving a reason. Specific conditions apply for products, services, and digital content.

Article 7 - Consumer Obligations

Consumers must handle products carefully during the reflection period and are liable for any diminished value caused by misuse.

Article 8 - Exercise of Withdrawal

Consumers must notify withdrawal within 14 days and return products in original condition. Return costs may apply.

Article 9 - Entrepreneur Obligations

Refunds will be processed within 14 days after withdrawal notification, using the original payment method.

Article 10 - Exclusion of Withdrawal

Certain products and services may be excluded from withdrawal rights, such as custom-made or perishable goods.

Article 11 - The Price

Prices include VAT and will not change during the validity period, except due to legal changes.

Article 12 - Compliance and Warranty

Products and services must comply with agreements and legal requirements. Additional warranties do not limit legal rights.

Article 13 - Delivery and Execution

Orders will be processed within 30 days unless otherwise agreed. Delays will be communicated to the consumer.

Article 14 - Duration Transactions

Consumers may cancel ongoing agreements under agreed terms and notice periods.

Article 15 - Payment

Payments must be made within 14 days unless stated otherwise. Late payments may incur additional costs.

Article 16 - Complaints

Complaints must be submitted clearly and will be handled within 14 days.

Article 17 - Disputes

Disputes are governed by Dutch law and may be submitted to the Thuiswinkel Disputes Committee.

Article 18 - Industry Guarantee

Thuiswinkel.org guarantees compliance with dispute decisions up to specified limits.

Article 19 - Additional Provisions

Additional provisions must not disadvantage the consumer and must be clearly documented.

Article 20 - Changes

Changes to these terms will be communicated appropriately and will favor the consumer where applicable.
